Terms of Service

These Terms govern your use of caltonbrown.com and related online services operated by Calton Brown Ltd. Purchases are governed separately by our Terms of Sale, Refunds, Returns and Cancellations policy and Shipping Policy. By using the website you agree to these Terms. Your statutory consumer rights are not excluded or restricted by them.
1. Who may use the website
1.1 You must have the legal capacity to enter into a contract where you live. Please read our Age and Access page for how we treat younger visitors.
1.2 You must use the website lawfully and must not interfere with its operation, security or availability.
1.3 You are responsible for the accuracy of the information you give us, including your name, address, email address and payment details.
2. Acceptable use
2.1 You must not use bots, spiders, scrapers, scripts or other automated tools to access, copy, monitor or extract content from the website, or to place orders, reserve stock or apply codes, unless we have agreed in writing.
2.2 You must not attempt to bypass security controls, interfere with checkout, introduce malicious code, probe or test the website for vulnerabilities without our permission, impersonate another person or business, submit false information, or use the website for unlawful or fraudulent activity.
2.3 Impersonation and lookalike sites. You must not create or operate a website, listing, social account or advertisement that suggests a connection with Calton Brown, uses our name, branding or imagery to sell goods, or sells counterfeit Calton Brown goods. Calton Brown goods are sold only through caltonbrown.com and our authorised channels. If you see a site or listing that claims to be us or to sell our products, please tell us at info@caltonbrown.com.
2.4 Automated agents. Where an AI agent or other automated tool acts on your behalf, these Terms apply to it as they apply to you, and you remain responsible for what it does.
3. Orders and your right to cancel
3.1 Orders are governed by our Terms of Sale. Submitting an order is an offer to buy. An automated acknowledgement confirms receipt only. We may refuse or cancel an order where reasonably necessary and legally permitted, as set out in the Terms of Sale. If we cancel a paid order, we will refund amounts properly due to you.
3.2 Right of withdrawal for customers in the European Union. If you are a consumer in an EU member state, you have the right to withdraw from your contract with us, for any reason and without giving a reason, within 14 days of receiving your goods, and the right to a refund as set out in the law. Customers elsewhere have cancellation rights set out in our Refunds, Returns and Cancellations policy. The full text of the EU right of withdrawal, how to exercise it and the model withdrawal form are in section 11.3 of our Terms of Sale, which every customer can read. You can withdraw by emailing returns@caltonbrown.com with your order number.
4. Product information
We aim to present products, descriptions, sizing, colours, materials, care information and availability accurately. Product pages carry written descriptions, measurements and care information, and reference photography of the actual item. Reasonable variations in colour caused by lighting or screens do not remove statutory rights where goods fail to match the contract.
5. Product imagery and our use of AI
5.1 How we use AI and digital editing. We use artificial intelligence tools and digital editing to present our products better, for example to adjust lighting and backgrounds, to build consistent layouts, to produce lifestyle and campaign imagery, and to show garments on models. We use these tools to present the product. We do not use them to change how the product looks. We do not alter the colour, fabric, texture, weave, finish, cut, proportions, stitching, construction, hardware, labels or logos of any item shown.
5.2 Disclosure. Where an image has been generated or materially altered using AI, including images of models and settings, we label it on the product page or on the image. The product shown in that image is based on the actual product.
5.3 Reference imagery. Each product page includes unedited or minimally edited reference photography of the actual item. Where presentation imagery and reference imagery differ, the reference imagery is the closer guide to the item.
5.4 Fit and models. Models, whether photographed or digitally generated, are shown for presentation. They are not a guide to how an item will fit you. The size guide and garment measurements on the product page are the accurate guide.
5.5 Order of priority. If sources of information about a product differ, this order applies: the written description, materials, measurements and care information first; the reference imagery second; presentation imagery, including any AI generated or enhanced image, third.
5.6 Your rights. Nothing in this section limits your rights. If goods you receive differ materially from their description or reference imagery, other than through normal screen variation, they are not as described and you may return them as set out in our Refunds, Returns and Cancellations policy.
5.7 If you think an image is misleading, tell us at info@caltonbrown.com and we will review the page.
6. British identity and product origin
Calton Brown is a British brand, founded and incorporated in London, England. Our British identity does not mean that every garment is manufactured in Britain. Manufacturing and fulfilment may take place internationally. Where country of origin information is required or expressly stated, it will be accurate.
7. Prices, promotions and errors
Prices are displayed in the selected currency. Calton Brown Ltd is not currently registered for VAT, so our prices do not include VAT. Delivery charges are shown before you pay. Import duties and taxes charged by your destination country are not included in our prices and may be payable by you to the carrier or to customs, as set out in our Terms of Sale and Shipping Policy. We may correct genuine typographical, technical, pricing or product information errors. If an error materially affects an order already placed, we will contact you and provide the remedy the law requires. Promotional offers are subject to the conditions stated when they are presented.
8. Our content and artificial intelligence
8.1 The Calton Brown name, branding, logos, website design, text, editorial content, product photography, size information, graphics and other original material belong to us or our licensors and are protected by copyright and other rights. You may not reproduce, commercially exploit, scrape or redistribute them without our permission, except as the law permits.
8.2 You may not copy, scrape, harvest or use our content, by any manual or automated means, to train, fine tune, test or improve any artificial intelligence or machine learning model, or to build a dataset, without our written permission.
8.3 You may not use our content to produce counterfeit goods or imitation product listings.
9. Reviews and customer content
9.1 If you submit a review, photograph or other content, it must be honest, based on your own experience, lawful, and not defamatory, abusive or misleading. You give us a non exclusive, royalty free licence to display it on our website and marketing for as long as it is published.
9.2 We do not pay for, write or edit reviews to change their meaning, and we do not suppress genuine reviews because they are critical. We may remove content that breaks these Terms.
9.3 You must not submit fake or incentivised reviews, or post reviews for a business you are connected to without saying so. Any creator or affiliate relationship must be disclosed in line with advertising rules.
10. Third party services and links
The website relies on third party services for payments, hosting, analytics, delivery, customer support, reviews, email and other functions. Their own terms and privacy notices apply to their services. We are not responsible for the content of third party websites we link to.
11. Website availability and security
We aim to keep the website accurate and available but do not guarantee that it will be uninterrupted or error free. We may suspend, change or withdraw parts of it where reasonably necessary for maintenance, security, legal compliance or operational reasons.
12. Chargebacks and payment disputes
If you believe a payment or order is wrong, please contact us promptly so that we can investigate. Nothing in these Terms prevents you from exercising a lawful right to dispute a transaction with your payment provider. We may give transaction, delivery and communication records to a payment provider or relevant authority where reasonably necessary to investigate a disputed transaction, fraud or abuse.
13. Suspension and ending access
We may suspend or restrict your access to the website, or decline future orders, where you break these Terms, where we reasonably suspect fraud or abuse, or where the law requires. We will not use this to remove a statutory consumer right.
14. Our liability
14.1 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence, or your statutory rights as a consumer.
14.2 Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms, and not for loss that was not foreseeable.
14.3 We provide the website for private use. We have no liability for loss of profit, loss of business or business interruption.
15. Privacy and cookies
Our Privacy Policy explains how we process personal information, and our Cookie Policy explains how cookies and similar technologies are used.
16. Notices

17. General
If any part of these Terms is unenforceable, the rest continues to apply. If we do not enforce a right immediately, we do not lose it. No one other than you and us has any right to enforce these Terms.
18. Governing law and courts
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, subject to the mandatory consumer protection rules of your country that cannot lawfully be excluded. If you are a consumer, you may bring proceedings in the courts of the country where you live.
19. Changes to these Terms
We may update these Terms from time to time. The version in force when you use the website applies. The effective date appears at the top of this page.
