This table is a summary. The full terms are below and prevail.

1. About these terms

1.1 These Terms of Sale apply to every purchase made from Calton Brown Ltd through caltonbrown.com. “We”, “us” and “our” mean Calton Brown Ltd. “You” means the person placing the order. “Goods” means the products you order. “Working Day” means Monday to Friday, excluding public holidays in England.

1.2 What forms your contract. Your contract with us consists of these Terms of Sale, our Refunds, Returns and Cancellations policy, and our Shipping Policy. Our Terms of Service and Privacy Policy also apply to your use of the website. If there is a conflict between them on a matter of sale, delivery, cancellation or refund, the documents are applied in the order listed in this paragraph.

1.3 Nothing in these terms limits any right you have by law as a consumer. If a term here conflicts with a mandatory right, the right prevails.

1.4 You confirm that you are buying the goods for personal use and not in the course of a business, unless we agree otherwise in writing.

2. Who we are

The seller is Calton Brown Ltd, a company registered in England and Wales, Company No. 17230415, trading as Calton Brown London. Registered office: 75 Shelton Street, Covent Garden, London WC2H 9JQ. Customer contact: info@caltonbrown.com for general enquiries, orders@caltonbrown.com for orders and delivery, and returns@caltonbrown.com for returns and refunds.

3. How a contract is formed

3.1 Your order is an offer to buy goods from us. The automated email you receive after ordering confirms that we have received your order. It does not mean we have accepted it.

3.2 We accept your order, and a binding contract is formed, when we send you a dispatch confirmation for the goods. If we send some of the goods in your order, a contract is formed only for those goods.

3.3 We may decline or cancel an order, and refund any amount you have paid for it, where the law allows, including because goods are out of stock, there is an obvious pricing or description error, payment cannot be authorised or verified, delivery is not possible or permitted, or we reasonably suspect fraud or abuse.

3.4 Please check your order carefully before you submit it. You can correct input errors before payment. After you submit it, contact orders@caltonbrown.com straight away if you need a change. See our Shipping Policy for what can be changed before dispatch.

4. Our goods and product information

4.1 Each product page carries a written description, materials, measurements, care instructions and imagery. We take care that these describe the goods you will receive.

4.2 Natural variation in fabric, dye and finish, differences between production batches, and differences caused by lighting or screen settings are not by themselves a fault or a failure to match the description.

4.3 Where a product has a characteristic, limitation or condition that is material to your decision to buy, we will tell you on the product page before you buy.

5. Product imagery and our use of AI

5.1 How we use AI and digital editing. We use artificial intelligence tools and digital editing to present our products better, for example to adjust lighting and backgrounds, to build consistent layouts, to produce lifestyle and campaign imagery, and to show garments on models. We use these tools to present the product. We do not use them to change how the product looks. We do not alter the colour, fabric, texture, weave, finish, cut, proportions, stitching, construction, hardware, labels or logos of any item shown.

5.2 Disclosure. Where an image has been generated or materially altered using AI, including images of models and settings, we label it on the product page or on the image. The product shown in that image is based on the actual product.

5.3 Reference imagery. Each product page includes unedited or minimally edited reference photography of the actual item, which shows its true colour and construction. Where there is a difference between presentation imagery and the reference imagery, the reference imagery is the closer guide to the item.

5.4 Fit and models. Models, whether photographed or digitally generated, are shown for presentation. They are not a guide to how an item will fit you. Please use the size guide and garment measurements on the product page, which are the accurate guide to fit and sizing.

5.5 Colour. Screens and devices display colour differently, so we cannot guarantee that your screen shows a colour exactly. The colour name, the description and the reference imagery are the best guide.

5.6 Order of priority. If sources of information about a product differ, this order applies: first, the written description, materials, measurements and care information in the product listing; second, the reference imagery; third, presentation imagery, including any AI generated or enhanced image.

5.7 Your rights. Nothing in this section limits your rights. If goods you receive differ materially from their description or from the reference imagery, other than through normal screen variation, they are not as described. You may return them under section 9 of our Refunds, Returns and Cancellations policy, at our cost, and you are entitled to the remedies in that policy and in law.

5.8 If you think an image is misleading. Tell us at info@caltonbrown.com. We will review the page and correct it where we agree.

6. British identity and product origin

Calton Brown is a British brand, founded and incorporated in London, England. That does not mean every garment is manufactured in Britain. Manufacturing and fulfilment may take place internationally. Where we state a country of origin for a product, it will be accurate.

7. Prices, currency, taxes and duties

7.1 Prices are shown in the currency selected for your market. Calton Brown Ltd is not currently registered for VAT, so our prices do not include VAT. Delivery charges are shown before you pay.

7.2 Duties and import taxes. Our prices and delivery charges do not include customs duties, import VAT, sales tax or carrier clearance fees. Your order is shipped to you from outside most destination countries, so these charges may be applied by your country’s customs authority or by the carrier. Where they apply, you are responsible for paying them to the carrier or to customs, on or before delivery. This is known as Delivered Duty Unpaid. We cannot calculate these charges in advance. We recommend checking your local customs authority’s rules before you order. See section 7 of our Shipping Policy and our Customs, Duties and Taxes page.

7.3 Currency conversion. If you pay in a currency other than the one we display, your bank or card issuer may apply its own exchange rate or fees. We do not control these.

7.4 Price changes. The price that applies to your order is the price shown when you pay. We may change prices at any time for future orders.

7.5 Errors. If an item is listed at a price that is a clear and obvious mistake, or a description or stock error affects your order, we will tell you, offer you the option of buying at the correct price, and cancel and refund in full if you decline. We do not revisit prices on orders already accepted and fulfilled.

8. Promotions, codes and creator offers

8.1 Promotional codes and offers apply only on the conditions stated when they are presented. Unless stated otherwise, they are limited to one per order, cannot be combined, cannot be exchanged for cash or applied to earlier orders, and may have an expiry date, minimum spend or product exclusions.

8.2 Codes issued to a particular person or group, including creator and ambassador codes, may be used only by the person or group they were issued to and only in line with the offer.

8.3 We may withdraw or correct a promotion, or remove a code from an order, where it was applied in error, was misused, or was obtained or shared in a way we did not permit. Orders already accepted are treated as set out in section 3.

9. Payment

9.1 Payment is taken through the payment methods shown at checkout. Your order is subject to successful authorisation.

9.2 We carry out reasonable security and fraud checks. We may ask you to confirm your identity or payment details, and may hold an order until you do. If payment cannot be authorised or verified, or an order cannot safely be processed, we may suspend or cancel it and refund any amount you have paid.

9.3 You must be authorised to use the payment method you choose.

9.4 Chargebacks. Please contact us before raising a payment dispute. Section 14 of our Refunds, Returns and Cancellations policy explains how we handle disputes and what records we give to your bank or card provider.

10. Delivery

Delivery areas, times, charges, customs and risk are set out in our Shipping Policy. Delivery estimates are not guaranteed times. For consumers, the goods remain at our risk until they are delivered to you or to a person you have named, other than the carrier. Ownership passes to you when we receive full payment.

11. Cancelling, returns and refunds

11.1 Our Refunds, Returns and Cancellations policy sets out how to cancel, how to return goods and how we refund you. It forms part of your contract.

11.2 Consumers in the United Kingdom, the European Union and South Africa have statutory cancellation rights that cannot be removed by any store policy. Where those rights differ from our policy, the statutory right applies.

11.3 Right of Withdrawal for customers in the European Union. This paragraph applies to consumers who live in a member state of the European Union and buy for personal use. It is set out here so that every customer can see it.

  • Your right. You may withdraw from your contract with us, for any reason and without giving a reason, within 14 days. The period ends 14 days after the day on which you, or a third party you have named who is not the carrier, take physical possession of the goods. If your order is delivered in several parcels, it ends 14 days after you receive the last parcel. It is enough to send your notice before the 14 days have expired.
  • How to withdraw. Tell us clearly that you have decided to withdraw: by email to returns@caltonbrown.com with your order number, by using this pre-filled link, Withdraw from contract here, or by using the model form below. We will confirm receipt by email without delay.
  • Returning the goods. Send the goods back to us without undue delay, and in any event within 14 days of telling us you are withdrawing. Wait for the Return Reference and return address we send you, put the Return Reference in the parcel and use a tracked service. You bear the direct cost of returning the goods, and you remain responsible for them until they reach us.
  • Loss of value. You may handle and try on the goods as you would in a shop. You are liable for any loss in value resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
  • Refund. We will reimburse all payments received from you, including the cost of standard delivery, without undue delay and within 14 days of being informed of your decision. We may withhold the refund until we have received the goods back or you provide evidence that you have sent them back, whichever is earlier. We refund to the payment method you used, at no fee to you. We do not refund the extra cost of a more expensive delivery option than our standard option.
  • Exceptions. The right does not apply to goods made to your specification or clearly personalised, or to goods sealed for hygiene reasons that you have unsealed after delivery. Sale and discounted goods are not excluded.
  • Legal guarantee. Separately, EU law gives you a legal guarantee of conformity of at least two years from delivery.

Full details are in our Refunds, Returns and Cancellations policy.

12. Faulty or non conforming goods

Goods must be of satisfactory quality, fit for purpose and as described. If they are not, you have the statutory remedies that apply where you live, such as repair, replacement, price reduction or a refund. Section 9 of our Refunds, Returns and Cancellations policy explains how to report a problem and what we do.

13. Order limits, resale and misuse

13.1 We may limit the quantity of any item per order or per customer, and may decline orders that we reasonably believe are for resale.

13.2 You must not use automated tools, bots or scripts to place orders, reserve stock or apply codes.

13.3 We may investigate activity that reasonably suggests fraud, payment abuse, false claims, code abuse, repeated misuse of returns or other unlawful conduct. Where the law allows, we may refuse or cancel orders and decline future orders. We will not use this section to remove a statutory consumer right.

13.4 Sanctions and export controls. We do not sell or deliver to anyone, or to any place, where doing so would breach sanctions, export controls or other laws that apply to us.

14. Our liability

14.1 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited, including your statutory rights as a consumer.

14.2 Subject to that, if we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach. We are not responsible for loss that was not foreseeable when the contract was made.

14.3 We supply goods for domestic and private use only. We have no liability to you for loss of profit, loss of business or business interruption.

15. Events outside our control

We are not responsible for a delay or failure caused by events outside our reasonable control, including severe weather, strikes, customs action, carrier disruption, pandemics, war and acts of government. We will tell you if your order is affected and, if the delay is long, you may cancel for a full refund. Nothing in this section affects your statutory rights.

16. Notices and our communications

16.1 We communicate with you in English, by email to the address on your order. You agree that notices may be given by email. Please keep your contact details up to date.

16.2 To give us a notice, email the address that fits the subject. Orders and delivery: orders@caltonbrown.com. Returns and refunds: returns@caltonbrown.com. Anything else, including legal notices: info@caltonbrown.com.

17. Complaints

If you are unhappy, please email info@caltonbrown.com with your order number. We aim to reply within 2 Working Days and to resolve complaints promptly. If we cannot resolve your complaint, you may contact the consumer protection body in your country. Nothing here limits your right to bring a claim.

18. General

18.1 These terms, with the documents in paragraph 1.2, are the entire agreement between us about your purchase.

18.2 If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right immediately, we do not lose it.

18.3 You may not transfer your rights under a contract with us to anyone else without our written agreement. We may transfer ours to a successor of our business, and will not do so in a way that reduces your rights.

18.4 No person other than you and us has any right to enforce these terms.

19. Governing law and courts

19.1 These terms and any dispute about them are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except as set out below.

19.2 If you are a consumer, you keep the mandatory consumer protections of the country where you live. You may bring proceedings in the courts of that country, and if you live in Scotland or Northern Ireland, in the courts there.

20. Changes to these terms

We may update these terms from time to time. The version in force on the day you place your order applies to that order. The effective date is shown at the top of this page.
